Refund and Cancellation Policy

1. Provider and contact
NuVation is provided by Jaco du Toit, a South African sole proprietor trading as NuVation Business Solutions. Refund and cancellation requests may be sent to info@nuvationbusiness.co.za. Include the business account email, PayFast payment reference where available, the affected product and a short description of the request. Never send a password, one-time code or complete card details.
2. Prepaid periods and automatic expiry
During a closed preview, registration, checkout and payment are unavailable. When paid checkout opens, every purchase will be once-off and prepaid. A base plan may be purchased for 1, 3, 6 or 12 months and terminates automatically on the expiry date accepted at checkout. NuVation does not automatically renew or charge the customer. Continuing after expiry requires a new order and a new successfully verified payment.
At checkout the owner expressly instructs NuVation not to continue the fixed term after the displayed expiry date. Expiry stops paid functionality but does not automatically delete the account or retained business records.
3. Add-ons, seats and capacity periods
An add-on module, employee seat or capacity increase may be selected for 1, 3 or 6 months, or by choosing Match main plan for the exact time remaining. Additions never offer a separate 12-month option. An addition may end earlier than the base plan but never later. Checkout disables every duration that would exceed the base-plan expiry. An active base plan cannot be extended, renewed early or stacked; a new base term can be purchased only after the current term expires.
Before payment, checkout displays the start and expiry dates, duration, standard monthly price, any partial-period calculation and the total payable now. A Match main plan price covers only the displayed remaining period. The addition also expires automatically and is never renewed or charged automatically.
4. Stopping access and early cancellation
No action is required to prevent another payment. The customer may simply allow a product to expire. The customer may also ask NuVation to end access earlier. An early-access termination request does not automatically create a refund except where the accepted order terms or applicable law require one.
Where section 14 of the Consumer Protection Act applies, the consumer may cancel a fixed-term agreement on 20 business days' written or other recorded notice. NuVation may deduct only a cancellation charge that is lawful and reasonable in the circumstances, and will calculate and explain the resulting unused prepaid amount or other remedy. Where required, NuVation will give written expiry notice not more than 80 and not less than 40 business days before expiry. Cancellation of access is separate from deleting a user or organisation; customers never have to destroy their records merely to stop paid access.
5. Refunds and corrections required by law or order terms
NuVation investigates duplicate or incorrect charges, payment without matching fulfilment, materially defective service, unavailable purchased service, unauthorised transactions reported through the proper payment channels, and any remedy required by applicable law. Depending on the circumstances, the remedy may include correcting access, re-performing the service, providing replacement access, crediting an amount or refunding payment.
Monthly usage allowances are service limits, not money, stored value, vouchers or transferable credits. Unused allowance does not roll over or itself create a refund. Deleting a record does not restore a monthly creation allowance already consumed. These rules do not remove a refund or other remedy required for incorrect billing, non-supply, defective service or another legally protected reason.
6. Refund method and timing
Approved refunds are processed through PayFast to the original payment method where supported and required by PayFast's rules. The refund of a particular charge will not exceed that charge; this does not limit a separate damages claim or another non-excludable remedy available under law. Processing and bank reflection times are controlled partly by PayFast, card schemes and financial institutions. NuVation processes an approved refund promptly and within any mandatory legal period, and provides a refund confirmation or receipt after PayFast accepts or confirms it. NuVation never represents an uncertain or rejected refund as completed.
7. Access after a refund, reversal or chargeback
When a full refund, reversal or chargeback is confirmed, the exact entitlement supplied by that payment ends unless another valid payment independently covers the same product and period. A partial refund results in the corresponding server-determined entitlement adjustment recorded with the refund. A customer cannot retain both the refunded access and the returned payment.
Refunding the base plan also removes the foundation required by attached add-ons, seats and capacity. If separately paid attached access would become unusable, NuVation addresses its overlapping unused portion through an appropriate refund, credit, replacement access or other remedy required by the order terms and applicable law. Refund or expiry does not automatically destroy the organisation or retained records.
8. Statutory rights
This policy is additional to and does not waive, replace or shorten any non-excludable right under the Consumer Protection Act, Electronic Communications and Transactions Act or other applicable law. Depending on the customer and how the transaction arose, rights may include electronic-transaction cooling-off, direct-marketing cooling-off, fixed-term early cancellation, a refund for non-performance or remedies for defective service.
Checkout asks the customer to request immediate digital activation after verified payment and expressly consent to performance beginning immediately. Under section 42(2)(d) of the Electronic Communications and Transactions Act, the section 44 cooling-off right does not apply where the service began with the consumer's consent before the end of the seven-day period. If that exception does not apply, an eligible consumer may cancel a service transaction under section 44 within seven days after the agreement was concluded, without reason or penalty, and a payment already made must be refunded within 30 days after cancellation. The consent does not waive any right that cannot lawfully be waived.
Where the Consumer Protection Act applies, fixed-term early-cancellation and direct-marketing rights remain available on the notice and conditions required by that Act. NuVation will not impose a charge described as an administration fee or cancellation penalty unless it is lawful, reasonable in the circumstances and clearly explained to the customer.
9. Separate project services
This policy governs prepaid NuVation ERP access. A separately quoted design, website, marketing, administration or other project service is governed by its own written quotation or agreement, including its delivery, cancellation and refund terms. That separate agreement cannot remove a mandatory consumer right.
